Advanced-Degree Professionals

Employment-based second-preference (EB-2) classification is available to a qualified candidate who:

  • Is a member of the professions holding an advanced degree (i.e., a master’s degree or above), or the equivalent thereof; or
  • Because of exceptional ability in the sciences, arts, or business, will substantially benefit prospectively the national economy, cultural or educational interests, or welfare of the United States, and whose services in the sciences, arts, professions, or business are sought by an employer in the United States. To qualify for second preference based upon “exceptional ability,” it must be established that the candidate is an individual who has “a degree of expertise significantly above that ordinarily encountered in the sciences, arts, or business.”

Unless qualified for the National Interest Waiver, an employment-based second-preference immigrant is subject to the labor-certification requirement.
